No might about it.

The statement was "3.1.4 is built with 3.9 source", not "3.1.4 is built only with 3.9 source". scsi.device being decended from 3.9 source is certain.

So, what then is the legal status of the various components in 3.1.4/3.2 that were based on 3.9 sources? As stated before there was stuff in 3.9 to which exclusive rights never went to any other party or certainly not to Haage&Partner and that the original authors (e.g. ThoR) can thus put into 3.2 again. But is that true for everything?

This whole 3.2 OS thing seems to add yet another dimension of legal implications...

As an user I don't ask on which legal construct 3.2 is based on, as I am not questioning is Coffein legal or not.

AROS is nearly to the point of making 3.1.4 or 3.9 irrelevant and this discussion moot.  Furthermore, and I may be mistaken, none of the aforementioned "companies" own the source code, but only the rights to it.  As I understand it, Acer owns the source through their purchase of Gateway.

I agree with BigGun however. While the advancements in 3.1.4 are good ones and 3.2 will go even further, 3.9 is still the better solution for "big box" Amigas.  That said, it would be interesting to assemble a sweet distro based on 3.1.4.  I know it can be done as AmiKit is scripted to "upgrade" to 3.1.4 from a 3.9 based installation of their distro.

Assuming they didn't sell it off sometime ago in a patent portfolio swap or something (that big corporations do all the time). But to the point, its buried and probably nearly impossible to find who actually still owns it.

My question wasn't about finger pointing. Coffin is a 3.9 distribution. 3.9 is an accepted AmigaOS and can (supposedly) be obtained legally. This fact is not changed by Coffin being illegal or not.

If, however, 3.1.4 is illegal, it may be banned all together  (given the legal battle between Hyperion and Cloanto). This, to me, does pose the question whether I as a user should get onto the 3.1.4-bandwagon or not. There is a probability that it will cause confusion and incompatibilities in an already very tiny software market. Should anyone write scripts making use of the new shell pipe features introduced with 3.1.4 only to find that in a few years 3.1.4/3.2 are gone and no future AmigaOS will support those new features? I guess there are more examples like that but I know too little about 3.1.4.

I don't think that legal discussions/speculation will help us here.
I would propose to not talk here about legal.

Regarding Amiga distros my view is.

If you want to use Coffin then use it as it.
If you not own a OS 3.9 license, then I would recommend to buy one.
Ebay and Amiga shops might offer it.

If you want to use 3.1.4 then use it.
But if you "mix" 3.1.4 with other distros like Coffin or Aros - please not expect that all will work in "harmony".

If you want to stay on the moral high ground then you can use AROS.
Here I would advice to use both AROS KICK and AROS WB together.
Using it together will work better than mixing AROS Kick with Coffin WB or Mixing Kick 3.1 with AROS WB.
